Expatriates wishing to marry Saudi women have to undergo a premarital test to ensure they do not take drugs. The new measure which took effect a few days ago makes it mandatory for foreigners to run the test before submitting their marriage applications.

Jeddah health premarital centre director Ali Al-Zahrani said results of the test would be announced within three days. The health authorities have exempted foreign women, who are married to Saudi nationals, from undergoing the test.

“The marriage application is rejected automatically in case the applicant tests positive”, Al-Zahrani said, adding that the test would also cover all types of narcotics and liquor. The authorities have reported no positive cases so far among the expatriates who applied to marry Saudi women.

The premarital test would also include Human Immunodeficiency Virus infection and Acquired Immune Deficiency syndrome (HIV/AIDS), hereditary diseases, hepatitiss B or C.

A Saudi man has to be between 40 and 65 years old to be able to marry a non-Saudi woman, and a Saudi woman has to be between 30 and 55 if she wants to take a non-Saudi husband, according to new rules.

Saudi nationals need special permissions to take non-Saudi spouses and the new requirements are on a 17-point list issued to govern the marriages of Saudis with foreigners, Saudi daily Al Eqtisadiya reported on Thursday.

Under the new rules, a Saudi man has to make at least 3,000 Saudi riyals (Dh2,935) a month and to have an adequate house or apartment to have his mixed marriage approved.

The woman that he wants to marry must be at least 25 years old and the age difference between the two spouses in all cases must not exceed 30 years.

If the applicant is divorced, at least two years should have passed following the separation before he applies to marry a foreigner, and in case he is married with a Saudi woman and wants a foreigner as a second wife, he must produce a certificate from a public or private hospital stating that his first wife is unable to assume all her marital responsibilities or is infertile. The certificate must be endorsed by the ministry of health.

The applicant must also sign a document stating that the approval of the marriage does not necessarily mean that his foreign wife would be granted the Saudi citizenship.

The rules for Saudi women planning to marry foreigners include a clause that stipulates that the age difference between them must not exceed 10 years.

The condition was set to ensure there is no exploitation of Saudi women, the daily said.

The only exception for the minimum age for the woman is the existence of a physical handicap or special needs, including being born to unknown parents.

In such cases, the minimum age is lowered from 30 to 27 and should be approved by the social affairs ministry.

A non-Saudi cannot take a Saudi wife if he is already married or if he had married a Saudi woman. He must also present a certificate showing that he has no criminal record in his country of origin and in Saudi Arabia.

He must also present evidence he is not suffering from any infectious or genetic diseases. He must not have been a member of the military in a foreign country, must not be on the lists of those banned from entering Saudi Arabia, must have a monthly salary of at least 5,000 Saudi Riyals and a valid residence permit and must possess an appropriate family residence.

He must not be stateless and must have a specific nationality and must prove it with a passport from his country that has at least another 12 months of validity. He must also clear all security checks to be carried out by the competent authorities in Saudi Arabia.

The Saudi woman has to sign a statement that her marriage with a foreigner did not necessarily mean he or their children would have the right to be granted the Saudi citizenship.

The new regulations call for the establishment of a committee tasked with looking into all applications by Saudis to take foreign spouses.

The members should give their opinion on the request within one month of receiving the application.

Around one third of the 28 million people living in Saudi Arabia are foreigners, working mainly in the construction and service sectors.

Instructions have been issued by supreme authorities to make drug tests part of the pre-marital medical check-ups especially for expatriates wishing to marry Saudi women or vice versa, informed sources have said.

The pre-marital medical check-up is obligatory for both Saudi men and women.

Authorities said foreigners should run this test before submitting their marriage applications.

Saudi men wishing to marry foreign women and foreign women wishing to marry Saudi men should obtain the approval of the concerned authorities before tying the knot.

The sources said the directives will prevent embarrassment the men and women usually experience for undergoing this particular test since it has now been made an integral part of the pre-marital medical examination.

They recalled that a number of official and public requests were made in the past few years calling for the drug tests before marriage. The sources said the test will prevent a number of family problems which might crop up as a result of one of the couples being a drug addict.

Five percent of 160 marriages of Saudi men to foreign women in 2013 and 2014 were to domestic workers, says a Ministry of Justice survey.

The Civil Status Court in Jeddah witnesses the signing of a marriage contract between a domestic worker and her sponsor after the man obtains permission from the relevant bodies that allows him to marry the foreigner and the domestic worker gets authorization from her family to facilitate the marriage procedures, said sources.

The survey said of the 160 marriages, 90 were with Moroccan women, 30 with Indonesian women, 13 with Filipinas, 22 with Sri Lankan women and five with Tunisian women.

Ahmad Al-Mabi, member of the ministry’s governance committee, said marriage procedures are similar to those followed for marrying Saudi women: The man has to apply to the governorate, which in turn refers the application to the Interior Ministry; after the approval, it is sent to the Civil Status court, which oversees the signing of the contract.

He said domestics need authorization from their guardians through their consulates/embassies.

He said Saudis marry maids either because the wife is ill or neglects her husband, or because many women leave the running of the house to the maid, which gives them the chance to get closer to their sponsors.

Psychologist Hani Al-Ghamidi said when a man marries his domestic worker, people criticize him and the community rejects the idea, but if one looks at the situation from a humane point of view, a man marrying such a woman is perfectly normal.

He added that working women might not look after their husbands the way they should, while domestic workers who are always there, attract the attention of the men, which leads to such marriages.

Al-Ghamidi confirmed that there are many stories of illegal relations between domestics and sponsors, but there are no clear figures.

Saudi Marriage Procedure Guidelines: Ministry Of Interior

14 March 2016 Update: I was informed by another FHWS reader whose Saudi confirmed with both the emarah and Ministry of Interior that the age requirement is set at the age of 35 but if the non-Saudi is a relative (2nd-3rd cousin) then the age is reduced to 30 years.

1 July 2014 Update: The age requirement for Saudi men to apply for the marriage permission has been reduced from 35 years to 25 years except for marrying a Moroccan which was only decreased to 30 years of age. This alert of the new change was provided by FHWS reader, Julieta. I was not aware of it being announced by the Ministry of Interior through Saudi news agencies. Sometimes the only way we know that something has changed is to either go to the government website or inquire in person at either the Ministry of Interior or emarah. 19 June 2010 Update: Interior Ministry Launches Human Rights Website. Colonel Ibrahim Al-Men’ai, Supervisor of the Human Rights Department at the ministry, said the website will allow the public to send in their remarks and complaints about the performance of security personnel. Apart from this, Al-Men’ai said the department has devoted a toll free telephone number, 989, for members of the public to express their opinions or report those security officials who have broken the law. Another objective behind the service is to familiarize the public with services of the ministry. It also aims to ensure that the public is made aware that security officials are not above the law and that justice will take its course against those who abuse their powers.

The Ministry of Interior (MOI) classifies an emirate as “An MOI organisation which provides civil administration for a region of the Kingdom (Province). The number of these Emirates in the Kingdom is thirteen.”

Single mother Nor Azimah Ibrahim who went missing in Madinah, Saudi Arabia had contacted her friend in the holy land to find out the process of marrying a Saudi Arabian national or local staying there.

Abdul Aziz Abas, who is now staying in Madinah to pursue a master’s degree at the Madinah Islamic University, said Nor Azimah contacted him via Whatsapp to seek information before she was reported missing.

“I was a little worried she asked such questions because I may have to manage a marriage or things like that because I am busy with my studies, examinations, doing my thesis,” he said when contacted by Bernama TV here, today.

Abdul Aziz who had known Nor Azimah, 31, when studying at a college in Malaysia had asked Nor Azimah to contact his wife for further clarification on the marriage process.

“I told Azimah to contact my wife for any information,” he said, adding that Nor Azimah did not contact him or his wife after that.

Abdul Aziz said the Saudi Arabian authorities had also called him to record his statement following Nor Azimah’s disappearance.

Nor Azimah, who has a daughter, is from Section 30, Shah Alam, Selangor, and went to perform the Umrah on December 11 with her father and mother.

Her mother, Zamhari Zakaria, 52, said the last time she was together with her daughter was on December 19.

Meanwhile, Zamhani who arrived in Malaysia on December 23, said the whole family should have returned home on December 22. — Bernama

The civil status courts have recorded 46 cases of Saudi men marrying African women over the last two years. Saudis marrying Sudanese women were the largest number with 16 contracts followed by 12 Eritreans.

The figure included 12 marriages to Nigerian women and five to Ethiopians. The number of Saudis marrying American women was seven while British women came last.

The Ministry of Justice is studying the imposition of penalties on Saudi violators who marry non-Saudi women without following the proper procedures. The penalties would be imposed on those who marry a foreign woman without documentation in any Saudi embassy or civil status courts if the marriage takes place in the Kingdom.

Rayan Mufti, legal adviser and lawyer, said the Ministry of Interior had made regulations to cover the marriage of a Saudi to a non-Saudi woman and vice versa.

There is no set punishment for a person who marries a foreign woman without documenting the marriage at a Saudi embassy or, if inside the Kingdom, through the civil status courts.

Such marriages result in children without documents to prove who they are and what their nationality is. Children should have personal documents to prove their identity and parents who fail to provide them will be punished.

The legal adviser added that the majority of undocumented foreign marriages inside the Kingdom are mostly entered into by military men and young people whose requests have been rejected because they were not of the legal age that enabled them to sign a marriage contract.

Scholarship students who marry outside the Kingdom often fail to document their marriages for fear of losing their scholarships. They may marry and leave their children without any identification documents.

He said that one penalty for a Saudi man marrying a non-Saudi included disciplinary action by the Board of Grievances and not being allowed to bring his spouse into the Kingdom.

Ibrahim Mubarak Al-Juwair, professor of social sciences, said compatibility between couples increases the chances of success of marriage. He pointed out that marrying a woman from another nationality needs skill and sacrifice to make a successful marriage.

Some men are tempted to marry foreign women, but after a while, differences surface and the marriage is terminated.
